The war in Europe and the Middle East, which started before the economy, which had been stagnant due to Corona, could recover, has also affected the domestic economy. Among them, commercial real estate, which is greatly affected by the general economy, is not doing well except for some central commercial districts such as Myeong-dong, and the recovery in vacancy rates is progressing slowly.
In particular, the high vacancy rate of old commercial buildings or office buildings worsens profitability and also lowers the asset value of the building. However, if the appropriate use is changed to meet the needs of tenants, the vacancy rate of the building can be lowered and real estate profitability can be improved. Recently, interest in changing the use of buildings, especially old commercial buildings, is higher than ever.
Changing the purpose of a building means abandoning the existing purpose of the building and changing it to a different purpose. If the purpose of the building is changed to the same or lower facility group as the current purpose of the building, you must report it to the head of the city, county, or district office with the required documents. If you want to change the purpose of the building to a higher facility group, you must obtain permission from the mayor of the special autonomous city, the governor of the special autonomous province, or the head of the city, county, or district office.
In the case of a change of use subject to a permit, it is stipulated that the design of a change of use where the total floor area of the part to be changed is 500㎡ or more cannot be done by anyone other than an architect. For this reason, the existing change of use permit has been applied for by proxy by the architect in charge of the design. However, according to Article 2, Paragraph 2 of the Administrative Litigation Act, except in cases permitted by law, it is stipulated that an administrative scrivener is delegated to perform the proxy work of applying or reporting to an administrative agency to obtain approval, permission, or license.
Recently, the Seoul Metropolitan Government sent an official document to 25 district offices restricting the acceptance of permits and licenses by non-administrative scriveners, and Gyeonggi Province and Hwaseong City are also providing guidance on the punishment provisions of the Administrative Litigation Act for applications by surveying firms and architectural design firms without authorization for permits and licenses. As a result, it is difficult to perform work in the real estate permit field, such as applications for development permits or changes in the use of buildings, without collaboration with administrative scriveners.
The real estate licensing field is one in which knowledge of land use areas and use zones according to the National Land Planning and Utilization Act and understanding of the building code are essential. It would be a good idea to work with a real estate administrative professional with professional knowledge and experience in real estate to find ways to increase the value of real estate, such as development permits and changes in building use.
