The amendment to the Real Estate Brokers Act, which elevates the Korea Real Estate Brokers Association to a statutory body, has passed a subcommittee in the National Assembly, potentially significantly altering the association's status and role. If the bill is approved by the plenary session, the association will no longer be a voluntary organization, but an official entity with legal authority.

The renewed momentum in these discussions stems from the growing need to restore market confidence amidst the recent surge in real estate-related damage, including jeonse fraud, fake jeonse (rental deposits), and fraudulent listings. This naturally leads to a shift toward strengthening the institutional framework for managing and supervising the brokerage industry to stabilize transaction order. The association has consistently emphasized its limitations, despite its internal self-regulation efforts, due to its lack of effective enforcement authority.

However, the market response is complex. The proptech industry, in particular, is concerned that if the association gains legal status, it could wield monopolistic influence in the long term. Past conflicts between some platforms and the association, as well as the possibility of mandatory membership or expanded guidance and enforcement powers, remain reasons for caution.

However, this revision excludes sensitive provisions such as mandatory membership and enforcement powers. The association explains that this upgrade is not a structure delegating authority like a government agency, but rather a mechanism to increase internal accountability and strengthen self-regulation within the industry. Given that platform companies are directly connected to the association's member brokers, some argue that cooperation, rather than unconditional confrontation, is necessary.

Ultimately, this change can be seen as a process of institutional adjustment aimed at stably managing the rapidly restructuring real estate market. While concerns and expectations intersect, the key lies in whether the brokerage and proptech industries can coordinate their roles and create a transparent and trustworthy transaction environment.

We hope that this revision discussion will serve as an opportunity to reduce market anxiety and establish a healthier real estate transaction ecosystem.
